How to File Illegal Recruitment Case in POEA

Filing a case against suspected illegal recruiters helps POEA enforce its stance against unauthorized recruitment of Filipino workers for overseas deployment. Such illegal recruiters not only make money from their victims, they also put lives at risk to human trafficking, abuse and other forms of maltreatment of Filipino workers abroad.

By moving forward and filing administrative/criminal case is an act to deter other criminals, while protecting the welfare of Filipino job applicants.

Requirements

Five copies of complaints – verified/under oath accompanied by the following documents:

  1. For Recruitment Violation Cases
    • List of Agency Personnel as verified from Licensing Branch
    • Agency Status as verified from Licensing Branch
    • Request to Docket Case from the Conciliation Unit
  2. For Disciplinary Action Cases
    • OFW Record/Information Sheet
    • Request to Docket Case from the Conciliation Unit

Procedure

Step 1: File the complaint along with the required documents at the Docket and Enforcement Division, 3rd Floor.

Step 2: Draw a numbered pingpong ball from the tambiolo to identify the Overseas Employment Adjudicator (OEA) who will handle the case.

Step 3: Receive file copy of the complaint with attached documents duly stamped “RECEIVED” indicating the case number and the OEA who will handle the case.

Step 4. Wait for the notice of hearing or preliminary conference.
